Orders under $25 (product value only) incur a $25 service charge.

Risk of Loss (EXW)

Buyer assumes responsibility once goods are delivered to the carrier.

Tariffs & Taxes

Buyer pays all taxes, duties, tariffs, and broker fees. Seller may pass through new or increased tariffs.

Payment Terms

Standard credit terms are Net 30 for approved customers.

Late Fees

Unpaid balances may incur late fees up to 1.5% per month.

Cancellations

Orders cannot be cancelled once complete. If production has begun, Buyer pays for work completed and incurred expenses.

Returns (RMA Required)

RMA required for all returns. Standard goods <1 year; chemicals <3 months. Restocking fees apply.

Repairs

Diagnostic rate $125/hour + materials. Written approval required. Payment required before shipment.

Warranty

Most products: up to 2 years. Educational articulators/facebows: up to 4 years.

Freight Claims

Buyer must file claims within 24 hours for visible damage or loss.

Shortages

Must be reported to Whip Mix within 3 business days of receipt.

Inspection Requirement

Buyer must inspect products within 3 business days of receipt.

Remedy Limitation

Remedy is limited to repair, replacement, or credit only.

Jurisdiction

Governed by Kentucky law. Disputes handled in Louisville, KY.

Q: A customer’s order is under $25. What do I say?

A: Explain the $25 minimum or the $25 service charge. Offer to add items to reach the minimum.

Q: A shipment arrived damaged. What do we do?

A: The Buyer must file a carrier claim within 24 hours. Document the issue and support as needed.

Q: Customer reports concealed damage after delivery. Is it valid?

A: Concealed damage must be reported to the carrier within 3 business days.

Q: Customer wants Whip Mix to cover freight for damage. What do I say?

A: Under EXW, transit risk is the Buyer’s responsibility; Whip Mix does not cover freight.

Q: Can we return chemicals?

A: Yes—only if less than 3 months from ship date, unopened, and an RMA is issued.

Q: When is an RMA required?

A: Always. No product may be returned, credited, repaired, or tested without an RMA number.

Q: Customer wants compensation beyond repair/replacement. What do we do?

A: Escalate. Remedies are limited to repair, replacement, or credit only.

Q: Who handles sales tax or tariff disputes?

A: Accounting handles tax/tariff disputes. Customer Service handles operational support.

Q: Can an order be cancelled after it ships?
